Subject of the following general terms and conditions
These general terms and conditions are the basis of an order with Darkhaus GmbH, hereinafter referred to as Dark Haus.
The General Terms and Conditions apply in the version valid at the time the contract is concluded. These can be adjusted by Dark Haus at any time. The place of jurisdiction is Wangen an der Aare, Switzerland. Orders at Dark Haus are subject to Swiss law.

Dark Haus takes the protection of the customer's personal data (hereinafter referred to as the customer) very seriously. We treat personal data confidentially and in accordance with statutory data protection regulations and the data protection declaration.

Offer and conclusion of contract
Dark Haus offers are non-binding.
A contract for the production of a tattoo is concluded when the customer orders the design for the tattoo and/or makes an appointment.
The customer also accepts that small deviations, changes to the designs, or even typing errors may occur. In this case, contract cancellation and/or contestation is excluded.
Dark Haus reserves the right to refuse an order. Dark Haus therefore excludes any claims of any kind arising from this rejection.
When concluding the contract, the customer agrees to the terms and conditions. He waives the right to assert liability and compensation claims against the tattoo artist/piercer or the studio. Other resulting costs are therefore excluded in any form; this also applies to complications and consequential damage of any kind.

The copyright of this website belongs to Dark Haus.
Any unauthorized use, reproduction, distribution, publication or commercial exploitation of the content on this website without the permission of Dark Haus is prohibited and will be subject to both criminal and civil law.

Information obligations​
The customer is obliged to provide truthful information when the meeting appointment or contract is concluded. If the customer fails to provide this information or provides incorrect data, in particular incorrect names and telephone numbers, Dark Haus can withdraw from the contract if a contract has been concluded. Dark Haus cannot be held liable for any consequences resulting from incorrect information provided by the customer.

Appointment
Appointments can be arranged via WhatsApp, email, Instagram or in person in the studio. The agreed dates are binding.
The studio reserves the right to require a deposit to confirm the appointment.
Appointment cancellation/postponement
If the customer would like to reschedule an appointment, they are obliged to contact the studio or tattoo artist 3 working days in advance in writing or by telephone. Otherwise the deposit will be forfeited.
If the customer wishes to cancel the appointment, he or she must do so in writing or by telephone no later than 3 working days in advance. Deposits will only be paid out in the form of a voucher.
Dark Haus fundamentally reserves the right to withhold advance payments made, especially if services have already been provided such as meetings, drawings or other advice.
Pricing
All prices are in Swiss francs including VAT.
The prices are set by the tattoo artists themselves and include rework within a specified time frame, unless other written agreements have been made and the customer has not violated any of our care instructions.
For tattoos on fingers, feet, palms and lips, rework is not included. This means that the full price can be charged for any rework.
Partial or installment payments are not possible.
If a deposit has been paid, this will only be deducted from the final amount if the customer can provide the original receipt for the deposit.

Vouchers
The minimum amount for gift vouchers is CHF 50.
Vouchers are not paid out, but are only used to offset an order.
All vouchers issued by Dark Haus are valid for the purchase of piercing jewelry, care products, accessories and for the creation of piercings or tattoos.
​ Risks
Any violation of physical integrity poses a health risk. With the order, the customer automatically consents to bodily harm and bears responsibility for it. To the best of its knowledge and belief, Dark Haus keeps the risks of errors and inflammation as low as possible. The customer is responsible for aftercare and maintenance. Dark Haus or the responsible tattoo artist will provide instructions and guidelines for this and the customer undertakes to follow them.
Tattoo designs
Designs created by the tattoo artists at Dark Haus Tattoo Studio are individually tailored motifs tailored to the customer and are subject to the copyright of the respective artist. These created designs will not be used as templates for other customers. The templates may only be used or taken away after consultation with the tattoo artist. Dark Haus does not copy templates from other tattoo artists.
Dark Haus does not check whether the copyright of customers' photo templates belongs to the customers. The customer assures Dark Haus that he owns the rights to this template and releases Dark Haus from all claims that may arise from any legal infringement or other violations of applicable law.
Dark Haus also reserves the right to reject motifs. ..

- ...which we cannot stand behind
Dark Haus also reserves the right to reject motifs without justification.
Dark Haus fundamentally reserves the right to publish photographs of the completed tattoos/drawings/piercings in magazines, drawings, books or on the Internet for its own advertising purposes. If the customer does not want this, this must be expressly mentioned in the declaration of consent.
Dark Haus assumes no liability if these publications result in unwitting copies by third parties.
Persons under 18 and reservations
People under the age of 16 will not be tattooed.
Persons under the age of 18 will only be tattooed if the minimum age of 16 is met, one of the legal guardians is present and both the customer and their legal guardian can show a valid ID. Instead of the legal guardian being present, the fully completed document “Declaration of consent for piercing/tattoo for minors”, which can be found on our website, can be presented together with a copy of the legal guardian’s ID.
People under the age of 14 will only be pierced if the customer can tell us that they want the piercing, if one of their legal guardians is present and both the customer and their legal guardian can show a valid ID.
People between the ages of 14 and 15 will only be pierced if they can present a valid ID and written consent, including a copy of the parent or guardian's ID (see document “Declaration of consent for piercing/tattoos for minors”).
People aged 16 and over can be pierced if they can show a valid ID.
Dark Haus does not tattoo/pierce people:
- who are under the influence of alcohol and/or drugs
- who are in an unstable mental/physical condition
- who are pregnant
- for bleeding disorders (hemophilia), hepatitis, HIV, allergies (tattoo), diabetes mellitus, sexually transmitted diseases, chronic or acute illnesses, immune deficiencies (congenital or drug-induced immunodeficiency or autoimmune diseases)
The customer undertakes to fulfill his obligation to inform Dark Haus and to provide truthful information.
Disclaimer
Dark Haus is not liable for tattoos and piercings unless negligence can be proven. If the customer has an allergic reaction to the products used, Dark Haus assumes no liability. Dark Haus assumes no liability even if you do not like the finished tattoo/piercing or if there are spelling errors in the tattoo motif. It is therefore recommended to check the design carefully before tattooing, especially to ensure that the spelling is correct.
The studio declines any liability for tattoos done by independent tattoo artists. In this regard, reference is made to the artists’ general terms and conditions.
Jewelry that has left the store or been worn cannot be exchanged or returned.
Dark Haus is not responsible for the loss or destruction of the customer's personal items and possessions brought into the tattoo studio.
No liability can be assumed for the accuracy, completeness or topicality of the content presented here on this website. Furthermore, no liability is assumed for damages that could arise from the use of this website.
Despite careful control of content, we assume no liability for the content of external links. The operators are solely responsible for the content of the linked pages. This declaration applies to all links on this website.
tattoo artist
All tattoo artists in our studio work as self-employed people at their own expense and risk. The artists themselves are solely liable for any problems that arise. Dark Haus rejects any responsibility and warranty in connection with the tattoo work and refers customers directly to the respective artist for any liability claims.
Place of jurisdiction
The place of jurisdiction is Wangen an der Aare, unless otherwise stated by law. Applicable law is subject to Swiss law.
Final provision

These Terms and Conditions may be amended by Dark Haus at any time.
If a clause of these General Terms and Conditions is invalid, the other clauses and the contract itself remain valid. The content of the contract is based on the legal regulations, unless these clauses have become part of the contract.
